Information Clause for Contact Persons

applies for contractors of Interseroh Organizacja Odzysku Opakowań S.A.

In accordance with Article 14 (1) of the Regulation (EC) No 2016/679 of the European Parliament and of the Council of 27 April 2016 in relation to the protection of individuals with regard to the processing of their personal data and on the free movement of such data as well as the repeal of Directive 95/46/EC (Journal of EU Laws Of 2016, item 119, p. 1) (hereinafter referred to as the GDPR), we hereby inform that:

1)    Data Controller

The Controller of your personal data is Interseroh Organizacja Odzysku Opakowań S.A. with its seat in Warsaw, ul. Wiertnicza 165, 02-952 Warsaw, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw, XIII Economic Division of the National Court Register, under no. KRS 459881, Tax Identification Number NIP 5213409980, REGON 140718909, BDO 000000172, share capital of PLN 2,500,000 paid in whole (hereinafter referred to as the  „Interseroh”).

2)    The source of personal data

Your personal data were made available to the Controller by an entrepreneur who has concluded a contract with the Controller on: 
a)    taking over and performing the entrepreneur’s obligation in the scope of re-use and recycling of packaging waste and/or  
b)    taking over and performing the entrepreneur’s obligation in the scope of product waste re-use and recycling and/or
c)    intermediary in organization of waste batteries and accumulators recycling and disposal 
and indicated you as a party who shall participate in the performance of the contract (hereinafter referred to as the „Entrepreneur”). 

3)    Scope of data supplied

The data supplied shall include: first and last name, phone number, e-mail address, official position. 

4)   Purpose of and legal basis for processing 

Your personal data shall be processed by the Controller in order to perform a contract concluded between the Controller and the Entrepreneur:
a)    taking over and performing the entrepreneur’s obligation in the scope of re-use and recycling of packaging waste and/or  
b)    taking over and performing the entrepreneur’s obligation in the scope of product waste re-use and recycling and/or
c)    intermediary in organization of waste batteries and accumulators recycling and disposal 
The legal basis for processing of your personal data by the Controller is Article 6 (1) (f) of GDPR, i.e. the Controller shall process your personal data to implement a legitimate interest in a necessity for performance of a contract concluded with the Entrepreneur. 

5)    Data recipients

Recipients of your personal data may be entities whom the Controller contract to services related to the personal data processing, e.g. IT service suppliers. Moreover, we may transfer your data to entities included in the group of companies we are a member of. The Controller may also transfer personal data to third parties who have their seats in the countries which are not members of the European Union or European Economic Area where a proper personal data protection level is sufficient according to the decision of the European Commission. In such a case, the Controller shall undertake any necessary actions to provide effective protection of personal data prior transfer thereof, particularly through conclusion of relevant contracts including standard contractual clauses defined by the European Commission. 

6)    Data retention period 

Your data shall be stored for the period necessary for achieving the objectives laid down in Section 4 hereof and after expiry of this period for time and in the scope according to applicable law. 

7)    Rights of the data subject

With regard to processing of your data, you have the following rights:
a)    access to personal data, including the right to obtain copies of the data,
b)    demand correction (rectification) of personal data – if the data are incorrect or incomplete, 
c)    request to delete personal data,
d)    request to limit processing of personal data, 
e)    object to process the data – if the data are processed in accordance with Article 6 (1) (f) of GDPR, 
f)    lodge a complaint to the President of the Personal Data Protection Office with its seat at ul. Stawki 2, 00-193 Warsaw, 
if you think that processing of your personal data infringes the provisions of GDPR. 

8)   Information on the automated decision-making, including profiling 

Your personal data shall be processed in an automated manner, including profiling.

a)    for collection and management of waste,
b)    the sale of waste,
c)    about cooperation,
d)    on the administration of trade,
e)    Green Contract,
f)    Another contract not mentioned above, the implementation of which requires the sharing of your personal data,
and indicated you as a party who shall participate in the performance of the contract (hereinafter referred to as the „Entrepreneur”).
